gunnercooke Intellectual Property Partner, John Lane, has advised Gelmart Industries, Inc. on the successful prosecution of two U.S. patents relating to its innovative sugarcane-based foam technology, a sustainable material used in women’s apparel.

The matter, which began in September 2023, is part of Gelmart’s broader strategy to develop and protect environmentally friendly alternatives to fossil fuel-based materials.

The patented foam, derived from sugarcane, is marketed under the SUGARCUP® and AEROFOAM™ brands and is a key component in the “KINDLY” line of products sold through Walmart.

gunnercooke U.S.’s John Lane led the matter, preparing and prosecuting the two U.S. patent applications through to issuance. He continues to oversee national stage filings in multiple jurisdictions, including Europe (EPO), China, and Japan.

The technology is notable for its role in advancing sustainability within product innovation in the apparel industry, supporting recyclability and reduced reliance on fossil fuels across the product life cycle.

The U.S. Patent & Trademark Office was the key external body involved, with additional filings now underway in foreign patent offices.
