Elliot J. Rosner represents individuals and companies with litigation matters in state courts, federal courts and before arbitration panels in New York, New Jersey and beyond, in addition to guiding clients in their corporate transactions.

Elliot has successfully litigated commercial disputes on behalf of clients in fields including real estate, health care, finance, education, food production, nursing homes and industrial manufacturing. The disputes he has litigated have involved issues such as breach of contract, common law fraud, breach of fiduciary duty, negligence, civil RICO, business divorce, defamation, employment disputes and estate litigation.

In his family law practice, Elliot regularly appears before New York and New Jersey courts in divorce and post-judgment matters. In this high-stakes and sensitive practice area, Elliot guides clients through the custody and financial-related issues of the divorce itself as well as post-judgment issues that may arise. He has negotiated dozens of matrimonial settlement agreements, as well as prenuptial and postnuptial agreements, including the crafting of creative solutions when warranted by unusual circumstances. He has also successfully litigated cases to trial and appeal when they could not be resolved.

Elliot has significant arbitration experience in both commercial and family law matters with a particular focus on Beth Din arbitration. He has secured favorable arbitration awards for his clients and litigated arbitration-related issues before the courts, including confirmation of arbitration awards and the scope and validity of arbitration agreements.

Elliot’s transactional practice includes advising clients at all stages – from preliminary negotiations through the drafting of agreements and closings – in matters such as mergers and acquisitions, joint ventures, newly formed entities, asset purchases and real estate financing. He has also advised clients on and drafted a wide variety of contracts including LLC operating agreements, employment agreements, corporate by-laws and shareholder agreements, non-disclosure agreements and contracts for the sale of real property.
